By purchasing this retainer product you agree to the following contract agreement

By purchasing this design retainer, and thus signing this agreement, you (“Client”) has retained Chykalophia Group (“Service Provider”) to proceed with graphic design services for the three month period starting at the date of purchase and recurring every three months from the date of purchase unless otherwise canceled, and agrees to the terms and conditions as set forth in this Agreement.

During this period, Service Provider agrees to devote up to the monthly hours per month as selected in the chosen package on assignments to be determined by the Client. Work will normally be performed at the offices of Service Provider, but occasionally may take place at other locations, as required. Work priority and scheduling will be at the discretion of Client. Work will normally occur during office hours of Service Provider between the hours of 9am and 5pm CST on weekdays.

Payment for the services will be to Service Provider at the chosen package monthly rate paid quarterly (every three months) and will be paid in full up-front. Autogenerated invoices and receipts will be sent out via the cart system.

Design services in addition to hours per month will be made available by Service Provider at the rate of $85 per hour and will be billed separately. Consulting services will be billed separately at the rate of $85 per hour. Expenses exclusive of normal overhead are not included in this agreement and will be bill separately. Examples of such expenses are: delivery services, printing costs, travel beyond the local city from Service Provider office, meals while traveling, stock photography, and third-party vendors required to complete the project. All invoices will be net 30.

All materials furnished by Client will remain the property of Client and will be returned upon request, or no more than 10 days from the termination of this agreement.

The results of any and all work performed by Service Provider for Client, including original creative work, will remain the property of the Client. Client may use this material in any way deemed appropriate. Service Provider reserves the right to display the completed work on their portfolio.

This agreement may be terminated on 30 days written notice by either Service Provider or Client. The agreement may also be terminated automatically if the retainer is not renewed automatically at the next payment cycle. In case of termination, Service Provider shall make a reasonable attempt to finish work in progress.

No refunds are given for work performed, though you may request a full refund for the current payment cycle if you have not requested any work during the current payment cycle.
